The legal requirement for safety inspections

The Health and Safety at Work Act 1974 states: “It shall be the duty of every employer to ensure, so far as is reasonably practicable the health, safety and welfare of all his employees.” This also includes contractors. Companies can be found guilty for breaches of safety law even if no-one is harmed. The law is based on the risk of harm to a person or person(s).

The Management of Health and Safety at Work Regulations 1999 state: Every employer shall make and give effect to such arrangements as are appropriate having regard to the nature of his activities and the size of his undertaking, for the effective planning, organisation control, monitoring and review of the preventative and protective measures. As a result, this statement refers to regular safety inspections must take place, with the specific aim of controlling and monitoring safety on site.

The Construction (Design and Management) Regulations 2015 (CDM) state: 4.—(1) A client must make suitable arrangements for managing a project, including the allocation of sufficient time and other resources. The Construction (Design & Management) Regulations (CDM 2015) are the regulations for managing the health, safety and welfare of construction projects. You may have been unaware of these legal requirements, as a result, you and your workers may be exposed to additional risk of harm. Regulation 13 within the CDM regulations places a duty with the contractor to ensure:

Duties of a principal contractor in relation to health and safety at the construction phase

13.—(1) The principal contractor must plan, manage and monitor the construction phase and coordinate matters relating to health and safety during the construction phase to ensure that, so far as is reasonably practicable, construction work is carried out without risks to health or safety.

So as a result of understanding the legal duties. Legally both the client and the contractor have a duty to ensure regular inspections are carried out. That being said, sometimes it will be a good option to have a high profile safety visit to reinforce the safety culture of the site and demonstrate the site management commitment to safety.

What happens when a construction site has a safety inspection?

The safety person will arrive at the time and date you arranged. Upon arrival, the safety person will make themselves known to the site manager. A request will be made to view the site documentation relating to safety. As a result of this request, The documents could include induction and accident reports, toolbox talk information etc. The site construction plan will also be checked. Other documentation will be requested. Don’t panic if the documentation is not there or incomplete, that is the purpose of the inspection. Following a site inspection the safety person will make recommendations on how to stay legally complaint. Following on from this any other actions required will also be highlighted.

After the site documentation has been inspected, the safety person will tour the construction site. This will result in the safety person highlighting safety concerns and failings, also good safety practises. Following on from the site tour, the safety person will usually sit down with the site manager or their appointed representative and discuss the findings of the inspection.

What happens after a construction site safety inspection?

As a result of the inspection, a written report will be created by the safety person and distributed to the relevant people. The report will contain all of the risks and hazards identified, along with any breaches of safety law. Recommendations will be made and a realistic time frame to rectify any shortcomings will also be proposed, along with who is responsible for actioning the findings. As the construction project progresses the construction site safety inspection documentation will build a realistic picture of the safety culture on site. A result of these inspections will lead to improved overall safety and promotion of a good safety throughout the site.
